1. Services Provided

Digital Nexus Specialists provides automated data hygiene, DNS authentication checks (MX/SPF validation), schema normalization, and data operations pipeline services (collectively, the "ScrubNexus Engine" or "Services").

The Services operate as an automated utility designed to clean, standardize, and flag lead data residing within Client-designated Google Sheets or integrated data intake pipelines. While our Services identify dead domains, syntax errors, and invalid DNS configurations, we do not guarantee specific email open rates, campaign conversions, or recipient inbox delivery. Third-party inbox providers (e.g., Google, Microsoft) maintain proprietary filtering algorithms beyond our control.

2. Service Execution & Platform Dependencies

Client acknowledges that the ScrubNexus Engine operates natively within the Google Workspace infrastructure and relies on public domain name system (DNS) lookups over HTTPS.

  • Digital Nexus Specialists is not liable for service interruptions, rate limits, or API delays caused by third-party platform downtime, including Google Workspace outages or upstream network disruptions.

  • Client is solely responsible for maintaining appropriate edit/access permissions to their designated Google Sheets to enable continuous background processing.

3. Payments, Retainers, & Usage Ledger

  • Billing & Fees: Fees are billed in advance via Stripe subscription or direct invoice. Tiers include a defined monthly row processing allowance.

  • Usage Ledger & Overages: Usage is tracked cumulatively using the engine's unalterable tracking ledger. Any processing volume exceeding the monthly included row allowance will be billed at the applicable per-row overage rate defined in the Client's active tier at the conclusion of the billing cycle.

  • Refunds: Due to the real-time computational resources consumed during processing runs, all ad-hoc batch purchases, setup fees, and recurring subscription payments are non-refundable once data processing has commenced.

  • Cancellations: Monthly retainer subscriptions may be canceled at any time prior to the next billing cycle via the Stripe customer portal or written notice. Services will remain active through the end of the paid billing period.

4. Limitation of Liability

Digital Nexus Specialists shall not be liable for any indirect, incidental, special, or consequential damages—including loss of sales, burnt sending domains, lost campaign velocity, or third-party email account suspensions—resulting from data processing errors or improper use of cleaned lists. Our total aggregate liability for any claim arising under these terms is strictly limited to the total amount paid by the Client for the specific service run or subscription month in question.

5. Data Privacy & Acceptable Use

  • Data Ownership: Client retains full ownership of all raw and processed data. Digital Nexus Specialists does not store, sell, share, or broker Client lead databases. Data is processed in-place within the Client's designated Google Workspace environment.

  • Acceptable Use: We reserve the right to immediately terminate Service and revoke queue access if the Client utilizes the ScrubNexus Engine to process illegal datasets, harvested passwords, or data intended for malicious phishing, unlawful harassment, or illegal spamming activities.

6. Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law principles.
